Hi, I really need some help with my complex situation, & hope some one can help me.

I got denied 8 years ago(16 years old) Last year I applied for ESTA after I was advised by the embassy I was fine to travel under the VWP as it had been 7 years since I was denied & havent tried to enter the USA previously. The ESTA was approved, with me being honest that I got denied.

Me & my husband booked a trip to see my sister who is a green card holder, and then onto new york. When I arrived at port of entry I was pulled into immigration ( which I expected ) and got told that I had been misleaded and should have been told to apply for a tourist visa. He let me through thanks to the ESTA approval, and if I wish to vist the states again I will have to apply for the tourist visa, I can never use VWP.

On my trip i never over stayed, and went back to the uk on time. On both parts of my journey.

My ties are I have a council place shared with my husband, and pay rent and all the usual living bills, I study and so does my husband, i have doctors, bank account, 2 dogs, large family, sister in law pregnant. Although I dont have a job I am on long term benefits, and can financialy support myself while in the states, also saving for my next trip.

I do hope some one can help, as I am so confused what documents I need etc

You shouldn't be too heavily penalised as you have never over stayed-and that is born out by the fact that you were allowed in on the ESTA.

You apply for the B2 using form DS-160, which can be submitted online, a passport that lasts at least six months more than your return date, and a photo that meets the required standards.

You'll need to pay a fee of $140, and go to the interview with supporting evidence that you are not planning on staying. Take your benefits book or letter if you paid into the bank, your council's housing agreement, recent bills, copy of your bank statement showing you have enough money (make sure there's money in there at the time), photos of you with the dogs, and photos of other friends and family. It shouldn't be too hard to obtain.

Yes, unless you adjust your status, your B2 will be valid for as long as it would have been valid if you had not married. Your marital status does not change your visa expiration date, as far as I know.

Your bride-to-be does not currently have a visa to enter the US? Are you planning to marry in her home country? Are you both planning to leave the US after marrying?

There is no need to buy a plane ticket before the interview. But let her know that she has to prove at the US Embassy that her stay in the US is only for a temporary period and that she will return once the period is over.

Plane ticket is just a thing to prove that you do not intend to leave US.

anderson, do you perhaps mean that a return plane ticket would be a proof that one does not intend to STAY in the US? A visitor visa would request that sort of proof, right?
